OFFICIAL RULES (“Official Rules”)

August 10, 2009 – March 31, 2010

NO PURCHASE, PAYMENT, OR OBLIGATION REQUIRED. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

User must agree to these rules by choosing “I accept and agree” in the registration email in order to be eligible to win prizes.

1.	Eligibility: Offered and open only to individuals who are lawful, permanent residents of the fifty (50) United States and District of Columbia who reside in and are physically located in the U.S. and D.C., and who are 18 years of age or older as of the date of entry. The promotion is void in Puerto Rico and other U.S territories and possessions, outside of the 50 United States and District of Columbia, and where prohibited by law. The promotion is subject to all applicable federal, state, and local laws. Persons who are immediate family members (parents, children, siblings) of, or live in the same household as employees, members or Managers, or are themselves employees, members or Managers of Mobile Thunder, LLC (“MobileThunderTM”) or its subsidiaries, affiliated companies, advertising, or promotion agencies are not eligible to participate. By entering, you agree to these Official Rules. MobileThunderTM, Attn: iScratcherTM Marketing, 4200 Research Forest Drive, Suite 150, The Woodlands, Texas, 77381 is the sponsor of the Promotion (the “Sponsor”).

2.	Timing: The iScratcher Mega Points Game GiveawayTM (the “Giveaway”) begins at 12:01:00 a.m. Eastern Standard Time (“EST”) on August 10, 2009, and ends at 11:59:59 p.m. EST on March 31, 2010 (the “Promotion Period”). Entries must be submitted by 11:59:59 p.m. EST on the last day of the Promotion Period, March 31, 2010, to be valid.
 
3.	To Enter: No purchase necessary. To enter the Giveaway: (i) Download the iScratcher application (the “Application”) to a compatible, internet-capable mobile touch device; (ii) go to “Account” in the Application and create an account (“Account”) by entering the applicable information into each field on the “New Account” screen (estimated time to complete: approximately two minutes), and selecting or tapping the “Done” button; and (iii), go to the “iScratchers” screen in the Application, select the iScratcher Mega Points Game, and then tap “Play Now!”  Failure to (a) complete all required fields when creating an account, including zip code, e-mail address, date of birth, gender, and password and (b) respond to the registration email and accept these rules will invalidate the entry. Submission of false entry information will also invalidate the entry. Entrant must play completely at least one (1) iScratcher game within the Promotion Period by wiping the screen on the mobile touch device to reveal underlying images and produce a pop-up window/message indicating whether the entrant has won game points (“Mega Points”). Incomplete entries are void.
The eligible entrant who accumulates the most Mega Points during one of the official time intervals to be announced by Sponsor on www.iscratcher.com during the Promotion Period (“Promotion Intervals”) will be eligible to win one (1) Cash Prize.  Sponsor or its agent will deliver a notification email (“Notification”) to the address provided by such entrant (“Winner”), which will contain the instructions for claiming the Cash Prize. Winners may be required to complete and fully execute an Affidavit of Eligibility and Liability/Publicity Release (“Affidavit/Release”), except where prohibited, as a condition of delivery of the applicable Cash Prize. A link to the Affidavit/Release form will be included in the Notification, and a printable version of the Affidavit/Release can be found at www.iscratcher.com/games/megapoints/affidavit.html. If MobileThunderTM does not receive the fully executed Affidavit/Release within fourteen (14) days of the date of Notification, the Winner will forfeit the Cash Prize. Additionally, if the Notification is returned as undeliverable, the Cash Prize will be forfeited. Any prizes forfeited during the Promotion Period will become available generally to be won by Giveaway entrants.   Any other method of entry is void. Non-compliance with any entry procedure will result in disqualification. In the event of a dispute regarding the identity of an entrant, the entry will be deemed to be submitted by the person in whose name the e-mail account is registered. The decisions of MobileThunderTM are final and binding in all matters relating to this Giveaway. Limit of one hundred (100) game plays per day per person. Entries generated by a script, macro, or other automated means are not eligible. Winning entries are subject to verification and approval of the Sponsor.

4.	Prizes: Sponsor will award during the Promotion Period up to one (1) One Five Hundred Dollar Cash Prize, four (4) Two Hundred Fifty Dollar Cash Prizes, three (3) Two Hundred Dollar Cash Prizes, and six (6) One Hundred Fifty Dollar Cash Prizes. Total Approximate Retail Value (ARV) of all prizes available to be awarded throughout promotion period: USD $3,000.00. Cash Prizes will be mailed to the address provided on the Affidavit/Release within one (1) to two (2) weeks from MobileThunder’sTM receipt of the completed and executed Affidavit/Release. This Giveaway is subject to all applicable federal, state, and local laws. All applicable taxes (including federal, state, or other tax liabilities, such as income taxes), fees, gratuities, and surcharges on prizes are the sole responsibility of the Winner. Moreover, any expenses not specified herein relating to participating or entering the Giveaway, receiving, completing, and submitting an Affidavit/Release, and acceptance and use of Cash Prizes are the sole responsibility of the Winner. Returned prizes will not be awarded. Odds of winning depend on the number of eligible entries received for the Promotion Period. For a list of the prize Winners, go to www.iscratcher.com or send a self-addressed and stamped envelope within thirty (30) days from the date of the end of the Promotion Period to MobileThunderTM, Attn: iScratcher Marketing, 4200 Research Forest Drive, Suite 150, The Woodlands, Texas, 77381. Allow four to six (4-6) weeks for delivery of the Winners List. You must specify for which game and prize you wish to have the list of Winners, or else MobileThunderTM will not be able to process your request.

5.	Other Considerations: Winners may be required to submit a photo, which will be used for MobileThunder’sTM promotional purposes only, a copy of a valid driver’s license or other valid photo ID showing the Winner’s name and address, and valid taxpayer identification number or social security number, in addition to completing a separate Affidavit/Release to validate eligibility and compliance with Giveaway Official Rules, before any Cash Prize will be awarded. Any person winning $600 or more from Sponsor in a calendar year will receive an IRS Form 1099 shortly after the end of the year, and a copy of such form will be filed with the IRS. By accepting a prize, the Winner agrees that MobileThunderTM and those acting under its authority may use the Winner’s name, age, city, state, biographical information, e-mail address, details of winning, picture/portrait, likeness or character, and/or voice for advertising, trade, and promotional purposes on a worldwide basis (including posting names online for the Winners List), in perpetuity and in any and all media now known or hereafter devised, except residents of Tennessee and where otherwise prohibited by law, without notification or additional compensation or consideration, and waives any claims to royalty, right, or remuneration for such use. BY PARTICIPATING, YOU AGREE THAT MOBILETHUNDERTM, ITS PARENTS, SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTION AGENCIES, AND ALL OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, SHAREHOLDERS, MEMBERS, PARTNERS, LICENSEES, ADVISORS, REPRESENTATIVES, AND AGENTS WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS BY YOU FOR ANY LIABILITY FOR ANY INJURY, LOSS, OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF THE PRIZE OR PARTICIPATION IN THIS OR ANY GIVEAWAY OR PRIZE RELATED ACTIVITY. BY ACCEPTING A PRIZE, WINNER AGREES TO INDEMNIFY AND HOLD HARMLESS MOBILETHUNDERTM, ITS ADVERTISING AND PROMOTION AGENCIES AND PARTNERS, AND EACH OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND REPRESENTATIVES FROM AND AGAINST ANY INJURIES, CLAIMS, DAMAGES, OR LOSSES OF ANY KIND THAT ARISE FROM OR ARE SUSTAINED IN CONNECTION WITH ACCEPTANCE OR USE/MISUSE OF PRIZE OR FROM PARTICIPATION IN THE GIVEAWAY OR IN ANY PRIZE-RELATED ACTIVITIES. This Giveaway is void in all jurisdictions where prohibited.

6.	Personal Data: MobileThunderTM reserves the right to use all information, including information on entrants obtained through the Giveaway, in accordance with its then-current stated Privacy Policy or our current stated Privacy Policy. Entrants who opt to join iScratcher.com’s or MobileThunder’sTM electronic mailing list agree to be contacted by email by MobileThunderTM. By entering this Giveaway, entrant agrees to such use of the personal data, which will be kept on MobileThunder’sTM server in Houston, Texas, USA. At any time, you may obtain a summary of the Personal Information about you on record with MobileThunderTM. You may request that MobileThunderTM dispose of or update any or all Personal Information about you. 7.	Internet Viewing: The Giveaway is intended for viewing only in the United States, and shall only be construed and evaluated according to U.S. law. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE, APPLICATION, OR SERVER, OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, MOBILETHUNDERTM RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

8.	Miscellaneous: By entering, entrants (i) agree to comply with these Official Rules including all eligibility requirements and (ii) agree to be bound by the decisions of the Sponsor, which are final and binding in all respects. All entries become the sole property of MobileThunderTM. In the event of a dispute, entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The “authorized account holder” is deemed as the natural person who is assigned to a valid email address by an internet access provider, service provider, or other online organization that is responsible for assigning email addresses for the domain associated with the submitted email address. A potential Winner may be requested to provide MobileThunderTM with proof that the potential Winner is the authorized account holder of the email address associated with the winning entry. If for any reason the Giveaway is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, human error, or any other causes beyond the control of MobileThunderTM that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Giveaway, MobileThunderTM reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, to cancel, terminate, modify, or suspend the Giveaway, and to select Winners from among the eligible entries received during the Promotion prior to such event. Should the Promotion be terminated prior to the stated end of the Promotion Period, notice will be posted at www.iscratcher.com. Any person attempting to defraud or tamper with this Promotion in any way will be ineligible for prizes and may be prosecuted to the full extent of the law. MobileThunderTM assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, or unauthorized access to, or alteration of entries. MobileThunderTM is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by the Sponsor on account of technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise, including any injury or damage to entrant’s or any other person’s phone or computer related to or resulting from participation or downloading any materials in the Giveaway. MobileThunderTM is not responsible for late, lost, illegible, incomplete, stolen or misdirected mail, or stolen, misdirected, blocked, or filtered email. Since Sponsor, its agents and/or Giveaway administrator will notify winners by email, it is the sole responsibility of the entrant to add the @iscratcher.com and @mobilethunderllc.com domains to entrant’s known/safe sender list. Further, it is the sole responsibility of the entrant to notify the Sponsor in writing if the entrant changes his or her email address; to do so, email support@iscratcher.com and type “Giveaway Address change” in the subject line. Sponsor, its parents, subsidiaries, affiliates, retailers, and advertising and promotion agencies, and all of their respective officers, directors, employees, representatives, and agents are not responsible or liable for: (i) garbled, illegible, incomplete, damaged, misdirected, late, or lost entries; (ii) errors or delays in transmission of entries; or (iii), any condition caused by events beyond the control of MobileThunderTM that might cause the Giveaway to be disrupted or corrupted. MobileThunderTM may prohibit you from participating in the Giveaway, at its sole discretion, if you repeatedly show a disregard for the Giveaway Official Rules, or act: (i) in a manner they determine to be not fair or equitable; (ii) with an intent to annoy, threaten, or harass any other entrant or MobileThunderTM; or (iii), in any other disruptive manner. MobileThunderTM is not responsible for prize utility or quality. Giveaway is subject to all applicable federal, state, and local laws and regulations. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, your rights and obligations, or our rights and obligations in connection with the promotion, shall be governed by and construed in accordance with the laws of the state of Texas, USA, without giving any effect to any choice of law or conflict of laws rules. By participating in this Giveaway, entrants agree that sole and exclusive jurisdiction for any action or proceeding arising out of or related to this agreement shall be in an appropriate state or federal court located in Montgomery County, Texas, and the parties unconditionally waive their respective rights to a jury trial.
